Terms and Conditions

General
All goods and services sold by us to you are sold on the terms of trade set out below. We may at any time vary these terms of trade. These terms of trade may not otherwise be varied unless agreed by us in writing. In these terms of trade, references to "we", "our" or "us" are references to Baby Glowy and references to "you" and "your" are references to the customer.

Acceptance
You will be deemed to have read and accepted these terms of trade when you confirm an order for goods or services by clicking on the "SUBMIT" button or "I ACCEPT" button. Once your order has been accepted by us this will constitute a binding contract for the supply of the goods or services on these terms of trade.

Price and Payment
For all goods or services ordered by you, you must pay the price for the goods or services specified on our website at the time your order is accepted by us. All payments are to be made by credit card or bank deposits. Your order will not be processed until payment is received in full.

We may contact you directly to confirm your credit card details. We reserve the right to vary the price list from time to time. All prices are in New Zealand dollars and are inclusive of GST (being tax levied in accordance with the Goods and Services Tax Act 1985 and includes tax levied in substitution for such tax).

Purchasing items on the from this website will transfer you to a securely hosted page on the Paymex website, where you can enter your details over a secure SSL encrypted site. We can also take credit card details over the phone if you would prefer to order that way.

Returns and Refunds
We offer a ‘no obligation’ right to a refund, provided our products are returned in original condition with packaging within 14 days after delivery. The items are to be returned to Glygo Limited at the customers expense. This only applies to standard stock items. For any items that are faulty, they must be returned to us by the customer with their original packaging and then we will arrange a replacement or store credit.


Delivery Costs for New Zealand Customers
You will pay freight and handling charges on any goods you order from us as follows:

    * All goods delivered within New Zealand (except gift vouchers) incur a freight and handling charge of $6.00 per order for all orders under $100.
    * All orders over $100 will be eligible for FREE DELIVERY
    * Gift vouchers delivered within New Zealand will not incur a freight charge.
    * Sorry, we do not currently ship outside New Zealand.
   
Payment
We accept payment by bank deposit, Paymex (Credit Cards) or internet banking and cheque. After your order is submitted we will automatically send you an email with the banking and cheque details. For customers that request to pay with credit card on the shopping cart, you will be transferred to a securely hosted page on the Paymex website, where you can enter your details over a secure SSL encrypted site. We can also take credit card details over the phone if you would prefer to order that way.

Out of Stock Items
If your order is out of stock, we will notify you as quickly as possible and advise the expected delivery time.

Shopping Cart
Our shopping cart is hosted by "Joomla Commerce " if for some reason the shopping cart is not working for you, please email us. When you click the buttons "buy now" in our non-store section, your browser will be redirected to the shopping cart/store site.

Use
This product is safe when in ordinary use, but should you or your baby have any particular sensitivities or other medical conditions, please consult your doctor if in doubt. All information published on our website is intended for educational and general information purposes only. It is not intended as medical advice or as a means to diagnose, treat, cure or prescribe for any medical condition. All health ailments should be treated by a doctor or qualified health professional. You are responsible for any treatment undertaken as a result of the information on this site, or treatment recommended by any other party.

Privacy
We are committed to ensuring your privacy. Information is collected at the time of sale in order to complete the sale and deliver the items. We also gather information if the customer requests to join our newsletter. We send out newsletters to all our customers with notification of new products or specials. In all our newsletters we give you the option to remove your name from our files. We will not give your details to any third party. You details will remain confidential at all times.

Lost Parcels
We send out an email to you when your order has been dispatched. Please contact us within 5 days of that date if your parcel has not been received so that we can lodge an enquiry with the postal and courier service. We do not issue replacements for items that are lost in the post, until after the investigation and claim is completed by NZ Post and NZ Couriers.


Property/Risk
Property and risk in goods ordered by you from us will pass to you upon delivery of the goods to your specified delivery address for the relevant order.

Liability
Subject to the provisions of this clause, to the extent permitted by law:

    * all warranties, representations and guarantees (whether express, implied or statutory) are excluded;
    * we will not be liable for any indirect losses or consequential damages of any kind suffered or incurred by you; and
    * we limit our liability to the replacement, or replacement cost and the delivery cost, of the relevant goods at our option.

If you are not acquiring goods or services from us for business purposes, you may have rights and remedies under the New Zealand Consumer Guarantees Act 1993 in which case the above exclusions and limitations (and any other provisions in these terms of trade which limit or exclude the rights and remedies available to you) will not apply to the extent these are inconsistent with your rights and remedies under that Act. If you are acquiring goods or services from us for business purposes, the New Zealand Consumer Guarantees Act 1993 will not apply
